Inhaltsangabe: Einleitung: Leasingverhältnisse decken eine Spanne von miet- bis zu ratenkaufähnlichen Verträgen ab. Durch die Vielfalt möglicher Vertragsausgestaltungen (Kaufoptionen, Andienungsrechten, Verlängerungsoptionen, Rückgewährvereinbarungen etc.) muß eine der beiden Grundformen erst herausgearbeitet werden. Für das Handelsrecht ergeben sich, daran anknüpfend, besondere Probleme bei der Zurechnung des Leasingobjektes zum Vermögen des Leasingnehmers bzw. Leasinggebers. Die Zurechnungskriterien der Handelsbilanz sind umstritten. Die Praxis orientiert sich stark an den steuerlichen Leasingerlassen. Diese sind jedoch nur für die Finanzverwaltungen verbindlich. In der deutschen Handelsbilanz ist die Zurechnung unabhängig von einer ggf. abweichenden Wertung des Steuerrechtes zu beurteilen. Die Behandlung von Leasingverhältnissen in der deutschen Handelsbilanz wurde in der Literatur größtenteils zwischen 1970 und 1980 geführt. In die Diskussion zurückgekehrt ist die Bilanzierung von Leasingverhältnissen als Teilproblem der Rechnungslegungsharmonisierung, da national unterschiedliche Bilanzierungsregeln die Vergleichbarkeit der Jahresabschlüsse erschweren. Auf Themengebiete wie Hersteller-Leasing, Fortfaitierungs-Leasing sowie auf Anhangangaben, Konzernabschlußbesonderheiten, Probleme bei vorzeitiger Kündigung und die Diskussion ob Leasinggegenstände im Anlagevermögen oder im Umlaufvermögen auszuweisen sind, gehe ich zugunsten einer vertiefenden Betrachtung der Grundlagen nicht ein. Für Spezialleasing und Immobilien-Leasing können die allgemeinen Grundsätze Anwendung finden, was bei diesen besonderen Vertragstypen i. d. R. zu einer vorgezeichneten Zurechnung führt.
