Recht und Sitte ist der Ausdruck des kulturellen und geistigen Niveaus eines Volkes in einer bestimmten Zeit epoche.
Im Altertum wie im Mittelalter, ja noch weit bis in die neueste Zeit beherrschte der Gedanke der gesetzlichen Anerkennung der Sklaverei und damit des Sklavenhandels alle Völker ohne Ausnahme. Ja die Kirche selbst verwarf durchaus nicht die Sklaverei nur gegen den Handel von Christen trat sie energisch und erfolgreich auf und verwendete selbst auf ihren Besitzungen Sklaven. 1) Erst das 12. Und 13. Jahrhundert brachte in Europa eine wesentliche Besserung. Die Sklaverei verschwand bis auf wenige Überreste; die Leibeigenschaft trat an ihre Stelle.
Italien, das im Mittelalter in erster Linie der Träger geistiger Entwicklung war, stellte sich auch hier an die Spitze einer moderneren und humaneren Auffassung, die das Recht jeden Menschen auf seine persönliche Freiheit anerkannte.
