Penalty' shall for each offence, be liable to a penalty not exceeding four hundred dollars and not less than two hundred dollars, together with the costs of prosecution, and in default of payment of such penalty and costs, shall be liable to imprisonment, with or without hard labour, for a term not exceeding three months, unless such penalty and costs and the costs of enforcing the same are sooner paid.
