The rapid improvement in all modern forms of transport has, side by side with its influence upon the commerce of the country, produced this further result, namely; that ever-increasing facilities are offered, both to those who prefer to establish their business relations with foreigners by means of personal interview, and to those who are induced by considerations of health, pleasure, or necessity to sojourn abroad. As a conse quence, the number of persons permanently or temporarily resident out of the jurisdiction of our Courts, whose evidence is necessary for the purposes of English litigation, is daily becoming larger, and applications to do what is known in general terms as take evidence on_, commission have grown accordingly. Hitherto there has existed no work dealing exclusively with this subject, the law and practice as to which have been found - when they could be found - scattered through the various authorities and text books. It is hoped that the present attempt to deal exhaustively with the various methods of taking evidence out of Court may prove useful, both to those who are seeking an order for such a pur pose, and to those who are executing an order when obtained.
