The views of members of the bar, of the people generally, and the mem bers of the constitutional convention itself are so divided upon it that it demands the most careful and impartial examination.

On the second of June, 1871, an act of the General Assembly of this commonwealth was passed, of which the first and only paragraph impor tant to consider for present purposes was in these words That the ques tion of calling a convention to amend the constitution of this common wealth be submitted to a vote of the people at the general election, to be held on the second Tuesday of October next.

At that election a vote was taken, and a large majority of the electors voted in favor of calling a convention.
