Leading cases in Constitutional Law are chie?y concerned with establishing the rights of individual citizens in the face of exceptional interference by the Executive, and a heavy crop of judicial decisions on this subject might, at first sight, have been expected in the years 1914 - 19. But in fact the instances in which such questions were raised and decided by English Courts are few. It is instructive to observe the reason for their scarcity; certainly the explanation is not to be found in the slightness or infrequency of official interference with private rights within these islands during those anxious years.
The Great War necessarily involved such action in an unprecedented degree. But public opinion and the House of Commons generally recognized as inevitable the claim of the Authorities to interfere drastically in the interests of national defence with individual rights, and the conduct of the Crown's advisers was not regarded as opposed to the interests of citizens but rather as representing the claims of the whole body politic against some individual member.
