Excerpt from Speech of Hon. L. M. Morrill, of Maine, on the Confiscation of Property: Delivered in the Senate of the United States, March 5, 1862
While, under the Constitution, a State of peace is the hor mal condition of the nation, and while that instrument care fully defines and limits the powers of the Government and guards the rights of the States, leaving them free to pursue their internal affairs in their own way, a state of hostilities, of insurrectionary war, is contemplated; and in such an event the power of the Government over all its'enemies, whether internal or external, is unlimited and unrestrained, and is con trolled only by the law of n'ations. The nation may then deal with its enemies in any way its exigencies may require, not repugnant to the principles of public law.
