The expression, giving way, means not crossing a vessel's bows, but going under her stern. A steam vessel putting her helm astarboard condemned in the damage, under the circumstances of the case.

Stable, steam vessels not justified in going at the rate of ten knots per hour in a dark night if a steam vessel going at that rate comes into collision with another vessel, without either party seeing each other, the steamer will be responsible for the damage.
