Publisher's Synopsis
Due to the constant environmental problems, judicial protection is necessary to guarantee a balanced environment. Because of this, the Federal Constitution of 1988 gave autonomy to environmental law, through its own principles and rules, among which is injunctive relief. This is one of the instruments that guarantees the effectiveness of the precautionary principle in protecting the environment. Due to the importance of the above, this study aims to address the institutes adopted in the new CPC, which refer to precaution and injunctive relief, as well as to address the ways in which environmental injunctive relief can be applied in order to guarantee the effectiveness of environmental law.
