Excerpt from Murphy Vs. Hubert, Supreme Court of Pennsylvania: Review of the Opinion of the Court, That the Act of March 21, 1772, Entitled "an Act for Prevention of Frauds and Perjuries," Does Not Apply to Trusts or Equitable Estates

The enactments of the Pennsylvania Act of Frauds, as well as those of the English Statute of Frauds, 29 Car. 2, c. 3, some of whose provisions the Pennsylvania Act adopts, will be fully ad verted to hereafter; but at present it is proper to state, that the point in controversy is whether a trust (or equitable estate in lands is comprehended by the words all leases, estates, interests of freehold or term of years, or any uncertain interest, in, or out of any messuages, manors, lands, tenements, or hereditaments for these are the words of the first section of the Act of 2lst March, 1772.
