Publisher's Synopsis
Volume 10 of the HKW comprises three contributions from 1923 and a recently discovered obituary from 1919 by Kelsen of his teacher Edmund Bernatzik. The three 1923 publications include two monographs which - in addition to the consolidation of the ' Reine Rechtslehre' (Pure Theory of Law) - reflect Kelsen's main scholarly interests of those years: with the second edition of ' Sozialismus und Staat' (Socialism and the State), Kelsen continued the series of publications against the then powerful currents of (Austro-)Marxism and Leninism; this monograph - introduced herein by Carlos Miguel Herrera, Paris - may be considered the most profound contemporary critique. And with 'Österreichisches Staatsrecht' (Austrian Constitutional Law) - introduced in this edition by Clemens Jabloner, Vienna - Kelsen presents the first comprehensive treatment of the constitutional law of the First Republic, thereby consolidating his position as the most important chronicler and mediator of the new constitutional law, in addition to his role in 1920 as the architect of the constitution.
