When criminal law studies speak of "shifting criminal liability", it is usually in a context that is critical of the system. Criminal law seems to be permeated by a tendency to move forward and the concept of offense only functions as an empty shell in the system. The possibilities of the legislature to describe "deeds before deeds" for criminal policy considerations in order to be able to counter "threats from injury" at the earliest possible stage seem to be limitless. The German and Hungarian criminal law systems each define the term "act" as a fixed point for criminal law. However, there are different experimental terms. The similarities and differences in the two criminal laws as well as the concurring observations of a forward shift of criminal liability in both countries have led to joint comparative research. The contributions gathered here are the result of this two-year research project.
