Court of Appeals decisions that analyze, interpret and apply provisions of the False Claims Act. * * * The FCA imposes significant penalties on any person who "knowingly presents, or causes to be presented, a false or fraudulent claim for payment or approval" to the Government or any person who "knowingly makes, uses, or causes to be made or used, a false record or statement material to a false or fraudulent claim." 31 U.S.C. § 3729(a)(1)(A)-(B). US ex rel. Wood v. Allergan, Inc., 899 F. 3d 163 (2nd Cir. 2018). * * * The FCA allows private persons, or relators, to prosecute qui tam actions "against alleged fraudsters on behalf of the United States government." United States ex rel. Watson v. King-Vassel, 728 F.3d 707, 711 (7th Cir. 2013); 31 U.S.C. § 3730. If the government does not intervene in the action, [] the relator may proceed with the case on his own, though still on behalf of the government. 31 U.S.C. § 3730(c)(3). If the action is successful, the relator is eligible to receive a percentage of the recovery. Id. § 3730(d)(1)-(2). US ex rel. Berkowitz v. Automation Aids, Inc., 896 F. 3d 834 (7th Cir. 2018).
