Publisher's Synopsis

Environmental Law and Climate Change' is a comprehensive study of Environment which has been subjected to the degradation by the human activities. The Constitution of India, originally, did not contain any direct provision regarding the protection of natural environment. Perhaps, the framers of the Indian Constitution, at the time of framing, thought it negligible problem that is why even it did not contain the expression "environment". But careful analysis of various provisions of the constitution reveals that three Articles, 47, 48 and 49 relate to environment. The aforesaid provisions are related to environmental protection and they are in Part IV of the Constitution which enshrines "Directive Principles of State Policy" which are not enforceable in law. Though the constitution of India had no direct provision for protection of environment but, taking note of Stockholm conference and growing awareness of the environmental crisis, amended it to add direct provisions for protection of environment. The book is divided into five parts and each part highlights the emerging issues on environment pollution, climate change, bio-diversity, forest conservation and constitutional protection of flora and fauna. This scholarly work is both broad in scope and extremely rich in detail. The readers will find this a useful reference book as well as a general text.
