Sie darf nicht unreife Ideen als wirkliche Rechtss�tze und selbst dann nicht verk�nden, wenn sie ihre Verwirklichung in der Zukunft klar vorhersieht. Das Recht als ein lebendiges ist immer ein gegenwartiges und unterscheidet sich dadurch so wohl von dem Rechte der Vergangenheit, das nicht mehr ist als iron dem Rechte der Zukunft, das noch nicht ist. Vergangenheit und Zukunft leben beide nur insofern, als sie sich in der Gegen wart begegnen und fruchtbar verbinden.
