Publisher's Synopsis

Part of a series, this update consolidates all changes made to insolvency law in 1990. It is designed for easy use, breaks down the subject into the important elements covering statutes, statutory instruments, cases, official publications, circulars and commercial publications.;After the Cork Committee Report and the amendments to the law made in the 1986 round of legislation, insolvency law, whilst hardly revolutionized is undergoing a phase of very real development. This is especially so in the case of corporate insolvency, almost all the cases here set out coming from this area rather than that of bankruptcy. Many of the cases in this update arise out of the notion of administration contained in Part 11 of the Insolvency Act 1986. Some landmark cases appear. For example, the area of postponement of rights is already leading to important and interesting legal debate.;The important case of Re Atlantic Computer Systems plc is reported here in some detail. There have been a number of cases this year which have shown a development of the law under the Company Directors Disqualification Act 1976 and these are also covered in some detail. Another case, Re M.C. Bacon Ltd, which so nearly contributed to the debate on shadow directorships remains instructive for other reasons and a full discussion appears.;A central objective of this update has been to explain what has happened in the recent cases and then to offfer some thoughts as to implications of the judgements given out.
