The 2015 Domestic Operational (DOPLAW) Law Handbook focuses on the Department of Defense providing assistance to domestic civil authorities, also known as Defense Support of Civil Authorities (DSCA). Circumstances involving the exercise of Homeland Defense authority and capabilities, i.e., "countering air and maritime attacks and preventing terrorist attacks on the homeland," are beyond the scope of this handbook.
Executive Orders (EOs), and DoD regulations provide the framework for, and set limits on, the use of military forces to assist civil authorities. While the types of domestic support operations vary widely, judge advocates must carefully consider whether the Posse Comitatus Act applies (18 U.S.C. § 1385 signed into law on June 18, 1878 by President Rutherford B. Hayes).
